Came across this when I googled, 'arms amendment act 2012'
Seems to read that we would be subject to criminal charges if we import a gun or parts for a gun that the police think, 'looks like a real gun', unless we are 'granted' a "special reason", so that we can obtain a permit to import. Just about all airguns look like a real gun, or can be interpreted as looking like a real gun. How about a replacement spring for a Dianna 34 from Vortek, $US18 + $US30.95 shipping + 1yrs imprisonment for not having a permit to import. Please read it for yourself at: http://www.firearmslawyer.co.nz/uploads/2/1/2/8/21282302/opinion_arms_amendment_act_2012.pdf In brief: " NICHOLAS TAYLOR - BARRISTER 08/05/2013 What is the effect of the Arms Amendment Act 2012? a) Airguns, airsoft guns and paintball guns 1) You will need to apply for an import permit under section 16 (1) of the Arms Act 1983 for any airsoft gun, paintball gun or airgun that looks like a real gun ... ...The permit to import must be obtained prior to import. It is a criminal offence with a penalty of one years imprisonment to import a restricted airgun without a permit to import issued before it lands in the country 2) You will need an import permit to import any parts for any airgun, paintball gun or airsoft gun that looks like a real gun ... 3) In order to get an import perm it you must have a “special reason” for the importation. This is very difficult to get and falls under police policy and discretion (section 18 (2) of the Arms Act 1983 Therefore, in my opinion, the reality, effect and purpose is a total import ban on all airguns, airsoft guns and paintball guns that look like a real gun... ... (even if they are not modelled on a real gun), and all parts in relation to them ... " |

I think you are misinterpreting this a bit. they are talking about paintball semi auto weapons. Single shot airguns springers and so forth do not apply to this and they have their own requirements because they are already classed as a firearm.

What the act will do is require owners of guns that may be a cat now, to get an E cat endorsement to still legally own them. The bit that people are up in arms about, is the fact that what is classed as a pistol grip can be changed according to this amendment with relative ease. You may have an a cat thumb hole stock one day, wake up the next and you're a criminal because its changed to e cat.
Some air rifles will be affected by that, others will be affected straight away. Steyrs, hammerli ar20's, walther alutecs, maybe ev2's are amongst the high end ones, but the cheapie a like crosmans m4-177 will become an e cat due to its pistol grip and appearance. Wait till it becomes like Australia where you need a fal to even buy air gun pellets..... The stupid part is, any law will only affect the law abiding. If someone wants to go and shoot people I hardly think they're going to be worried about the fact they don't have the right licence, if they have one at all. Should make it like parts of the states where it's compulsory to have a firearm, a lot less crime when the crime know everyone else has a gun as well :) |

Hi guys,
I didn't do the interpreting. The lawyer chap, Nicholas Taylor did. From his website, he is a " Firearms Law Specialist" with "... 16 years experience with firearms law in New Zealand and can assist with firearms licence revocations, firearms returns, customs issues, import permits, dealing with the police and any charges in both District courts and High courts." It's from his, "The Arms Amendment Act 2012 Legal Opinion - 8 May 2013" (the link above) |
